PLAIDOYER SUR LA PREUVE AUDIO-VISUELLE EN DROIT POSITIF DE LA REPUBLIQUE DEMOCRATIQUE DU CONGO

L’examen sur l’admission de la preuve audio-visuelle en droit positif de la République Démocratique du Congo, sur ce, un effort mental a été déployer pour répondre à cette préoccupation qui va captiver toutes nos pensées ;  au cours de nos analyses, celle-ci joue un rôle important  dans l’administration de la preuve.

Ce pourquoi, la nouvelle technologie a beaucoup développé le système judiciaire  du point de vue lenteur et à certaines inefficacités. 

Donc, elle semble être une solution efficace ou profitable pour tous les protagonistes du procès tant civil que pénal, le législateur Congolais devrait actualiser ou ajouter dans la hiérarchie de la preuve,  audio-visuelle comme le sixième mode.

Abstract

This study examines the admissibility of audiovisual evidence within the positive law of the Democratic Republic of Congo (DRC). To this end, a rigorous analytical effort has been deployed to address a concern that remains central to legal discourse: the pivotal role of such evidence in the administration of proof. New technologies have significantly advanced judicial systems, addressing procedural delays and certain inefficiencies. Consequently, as it appears to be an effective and beneficial solution for all protagonists in both civil and criminal proceedings, the Congolese legislature ought to update the legal framework by integrating audiovisual evidence as the sixth formal mode within the hierarchy of evidence.
